Benton County currently enforces subdivision rules and
regulations in the unincorporated areas of the county. However, Benton
County currently does not have zoning in the unincorporated areas of the
county. The use of zoning in the unincorporated areas of the county has been
a topic of discussion in recent years. Below is a list of the drawbacks of
zoning as identified by the Benton County Planning & Development Department.
Regulation of property Zoning regulations limit the use of
property to a specific set of permitted uses. Many people believe that this
is an unnecessary regulation in the use of private property. Additionally,
zoning may interfere with the free market system which many believe to be an
economic disadvantage.
Restrictive nature of zoning Zoning regulations restrict the types of development that can occur on a
particular piece of property. Under zoning, land owners must develop their
land in compliance with a narrow set of permitted uses or seek permission
from the local government to develop the property in a different manner.
Complexity of zoning regulations/Red-tape; bureaucracy Zoning regulations are often very detailed and complex. There are some
individuals that may find zoning rules and regulations difficult to
interpret or too detailed. Additionally, zoning regulations may increase
“red-tape” or the time needed to receive approvals or permits from the local
government.
Impact on land prices It is held that zoning stabilizes or increases the value of property. If
property values rise, then it may be reasoned that property costs and taxes
will also rise. This may be a disadvantage to some who cannot afford higher
property costs or property taxes.
Citizen complaints/Enforcement Zoning regulations often allow a significant amount of citizen input in
the decisions made by the local government. However, due to the significant
amount of citizen input, proposed developments may be hindered by citizen
complaints or “not in my backyard” (NIMBY) comments against the proposed
development. Additionally, enforcement of zoning regulations may increase
costs for ensuring compliance within the jurisdiction of the local
government.
